These Terms of Service ("Terms") govern your access to and use of racket.today("we," "us," or "our") at racket.todayand our related services (collectively, the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
Eligibility
You must be at least 13 years old (or the minimum age required in your jurisdiction) to use the Service. If you are under 18, you represent that you have permission from a parent or legal guardian. The Service is intended for users in Canada and the United States.
Your account
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to provide accurate profile information and to keep it up to date. You may not share your account, impersonate another person, or create accounts for anyone other than yourself without permission.
We may suspend or terminate your account if you violate these Terms, misuse the Service, or if we reasonably believe your account poses a risk to other users or to the Service.
Using the Service
racket.today helps racket-sports players connect, organize games and events, share posts, and message each other. We provide the platform; users are responsible for their own interactions, scheduling, and in-person activities.
You agree not to:
- Use the Service for any unlawful, harmful, or fraudulent purpose
- Harass, threaten, abuse, or discriminate against other users
- Post false, misleading, or spam content
- Upload content you do not have the right to share, or that infringes others' rights
- Attempt to access other users' accounts or our systems without authorization
- Scrape, reverse engineer, or interfere with the normal operation of the Service
- Use the Service to solicit users for unrelated commercial purposes without our consent
User content
You retain ownership of content you submit through the Service, including profile information, posts, comments, messages, and media. By posting content, you grant us a non-exclusive, worldwide, royalty-free license to host, store, display, and distribute that content solely to operate and improve the Service.
You are solely responsible for your content and for any consequences of sharing it. We do not endorse user content and are not obligated to monitor it, but we may remove content or restrict accounts that violate these Terms or applicable law.
Games, events, and in-person activities
Games and events listed on racket.today are created and managed by users, not by us. We do not guarantee the accuracy of event details, participant skill levels, venue availability, or safety conditions. You participate in games and events at your own risk.
You are responsible for your own conduct, equipment, transportation, and compliance with venue rules and local laws. racket.today is not a party to agreements between users and is not responsible for injuries, property damage, disputes, no-shows, or other issues arising from in-person play.
Payments
Some events may require a fee set by the event organizer. When payments are enabled, checkout is processed through Stripe. We are not the seller of event access; fees are collected on behalf of the organizer subject to Stripe's terms and applicable payment rules.
Refunds, cancellations, and payment disputes are primarily between you and the event organizer unless otherwise required by law or stated in the event listing. We may help facilitate communication but are not responsible for organizer refund policies.
Intellectual property
The Service, including our name, logo, design, and software, is owned by us or our licensors and is protected by intellectual property laws. These Terms do not grant you any right to use our branding except as necessary to use the Service in accordance with these Terms.
Third-party services
The Service may integrate with third-party services such as Google sign-in, Stripe, Supabase, and email providers. Your use of those services may be subject to their own terms and policies. We are not responsible for third-party services.
Privacy
Our collection and use of personal information is described in our Privacy Policy. By using the Service, you also agree to that policy.
Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, RACKET.TODAY AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE OR PARTICIPATION IN USER-ORGANIZED ACTIVITIES.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (USD $100), EXCEPT WHERE LIABILITY CANNOT BE LIMITED UNDER APPLICABLE LAW.
Indemnification
You agree to indemnify and hold harmless racket.today and its affiliates from any claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your content, your violation of these Terms, or your interactions with other users.
Changes to the Service and Terms
We may modify, suspend, or discontinue any part of the Service at any time. We may also update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page. Continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
Governing law
These Terms are governed by the laws of Canada, without regard to conflict-of-law principles, except where mandatory local law applies. Any dispute arising from these Terms or the Service will be resolved in the courts located in Canada, unless applicable law requires otherwise.
